Business and Investment Visas, including EB-5, E2 and H-1B
EB-5 Visa
The EB-5 immigrant investor visa program was established in the Immigration Act of 1990 to create U.S. jobs by attracting foreign capital to the United States. 10,000 immigrant visas per year are available to qualified individuals seeking to obtain permanent residence in the U.S. Permanent resident status under the EB-5 category is available to investors, either alone or coming with their spouse and unmarried children (under 21). A qualified alien investor must invest in a new commercial enterprise, invest $1 million or $500,000 in a Regional Center or in a “targeted employment area”, and create at least 10 positions for US citizens or authorized immigrant workers.
The immigrant investor, or EB-5, program is a highly beneficial permanent residence option for the wealthy individual. Since there is no quota waiting list in this preference category, it enables a foreign national to obtain permanent residence status more expeditiously than with most other options.
E-2 Visa
The E2 Treaty Investor visa allows nationals from countries that have treaties of commerce and navigation or bilateral agreements in effect with the U.S., to enter the U.S. for the purpose of directing and developing the operations of an enterprise they have invested in, or are in the process of investing a substantial amount of capital. Treaty investors may be accompanied or followed by spouses and unmarried children who are under 21 years of age.
H-1B Visa
The H-1B category of nonimmigrant visa enables professionals who have a bachelor's degree or equivalent college-level education to live and work in the U.S. legally. It allows U.S. employers to employ foreign guest workers skilled in specialty occupations only when qualified U.S. citizens or residents are not available. H-1B petition must be filed by the employer. H-1B work-authorization is strictly limited to employment by the sponsoring employer. This is a temporary work visa that is initially valid for three years, but can be extended to a maximum stay of six years.
